Regulations for using the Parking in the Adgar Wave Building
These regulations (below “the Regulations”) regulate the rules of using parking spaces outside and inside Adgar Wave buildings.
Definitions:
“ADGAR” – Owner of the Adgar Wave Building represented by the complex manager.
Access Card – contactless card assigned to the User, providing access to the Parking, programmed on the basis of a separate contract.
Ticket Office – cash registers for payment of fees, it is located in the Adgar Wave Building.
Parking – surface parking, and underground parking with parking spaces under the Adgar Wave building.
Personnel – employees of the security company.
User – any person driving a vehicle in the Parking lot.
1.GENERAL PROVISIONS
- By driving a vehicle to the Parking area, the driver and any other user of the vehicle (including the passenger) agrees to comply with the provisions of these Regulations defining the rules of using the Parking. Using the Parking means the movement of the vehicle, stop or parking the vehicle on its premises.
- The user of the Parking is obliged to comply with all instructions of the security services, Adgar security personnel and management employees (below “the personnel”).
- Traffic in the Parking area is carried out according to the instructions of ADGAR employees or Personnel, and the installed road signs. there are Appropriately applied the provisions of the Act of 20 June 1997. Traffic law (the Journal of Laws No. 98, item 602 with later amendments)
- An user of the Parking agrees for the ADGAR charging a fee (one-time entry ticket “the Ticket”) for the use of the Parking, according to the price list constituting Annex No. 1 to these Regulations (“the Price List”), unless he/she uses the Parking on the basis of a separate Agreement concluded with ADGAR.
- The driver of the vehicle which is moving within the Adgar Wave area should have the required permissions, meeting the requirements set by law.
II. ORGANIZATION OF THE PARKING
- The Parking run by ADGAR is a supervised parking lot, unguarded, in which the parking spaces are available on the basis of a purchase of the Ticket, lease agreements or separate arrangements with ADGAR.
- In order to ensure safety in the Parking lot, the personnel has the right to inspect the vehicle, including checking its technical condition, checking the contents of the luggage compartment, also external racks, and the interior of the vehicle. The vehicle user is obliged to keep the vehicle in the place indicated by the Personnel, and then to help during the above control activities.
- Parking Users are entitled to use the Parking infrastructure only to park the vehicle and get to the parked vehicle to leave the Parking. In order to ensure safety, pedestrian traffic is prohibited in the ramps area.
- There is a possibility to use the roads by cyclists only to reach the designated parking spaces and rooms with showers. A cyclist is obliged to drive the bike on the entry and exit ramp (not ride a bicycle).
- It is forbidden to leave bicycles in places not intended for this purpose.
III. TERMS OF RENTING A PARKING PLACE
- the Access Card entitles to use the parking space on the Parking, depending on the type of purchased subscription or Ticket.
- Number of parking access cards for a given tenant, is equal to the number of rented parking spaces, unless the separate entries, e.g. in the rental agreement, provide otherwise.
- The Parking is available to Users 24/7 a week. The time of using the Parking for of the Access Card holders is also specified in the provisions of separate agreements or arrangements.
- the Access Card holder, who exceeds the parking time for which the type of card entitles, is obliged to make an additional payment in the amount specified in the Price List or in a separate agreement.
- The condition for renting a Parking space is signing a contract with Adgar for rental of a parking place in the subscription system and/or other arrangements with ADGAR, in the hour system for collection of the Ticket.
IV. FEES AND PARKING TIME
- The parking fee is calculated in accordance with the Price List.
- The parking fee is paid at the marked Ticket Office or under the terms of the rental agreement.
- The fees can be paid:
- outdoor parking – cash register – cash and credit card, without any amount limits
- external parking – column at exit – ONLY a proximity card, to the transaction value of PLN 100 PLN
- underground parking – cash register, on level -1 – only with a card.
- Tenants have the right to validate parking tickets for their guests at their own expense.
- The driver of the vehicle may leave the Parking only after paying for parking at the Ticket Office.
- The Ticket or the Access Card entitles to park only in designated places.
- After paying the Ticket, the driver of the vehicle has 15 minutes to leave the Parking without additional charges. In the event of exceeding this time, the parking fee is charged according to the price list, counting the fee for each started hour.
- The holder of the purchased subscription (in case of problems with entering the Parking) is obliged to collect a single ticket, and immediately report to the security guard at reception A along with the collected ticket. After verifying the rights, the departure will take place free of charge.
- The subscription holder with access to the Parking, in the case of problems with the Parking exit (when an access card or parking system is not working), should call the security service by using the intercom system (handset button in the parking column). After verifying the entitlements, the barrier will be raised manually by the personnel.
- People who use the Parking commercially (one-time ticket) in the case of difficulties with the Parking exit (problems with the card, payment) should immediately contact the Personnel by using the intercom system (handset button in the parking column of in the Ticket Office). and then, if it will be necessary, go to the reception desk A for formalities.
- In the event of failure of the Ticket Office, the payment takes place in the next, the nearest Ticket Office, or exit column (only a contactless payment). In the event of failure of all Ticket Offices, the payment takes place at the reception desk A.
- In cases when the exit zone is blocked, an access card holder can leave the Parking using the entry lane and the column placed on the facade of the building. This operation is done on the responsibility of the driver.
- The fee for a lost ticket is PLN 100 gross and is made at the reception desk A.
- Leaving the Parking without a paid Ticket (eg. by following another vehicle) will be treated as an offense or extortion and will be reported to the police.
- ADGAR recognizes the person submitting the Access Card or the Ticket as a person who is authorized to drive a given vehicle and leave the Parking with this vehicle.
- The User who wishes to receive an invoice, informs about it the personnel at the reception A and leaves the data necessary to issue an invoice. The invoice will be issued within 7 days and delivered to the User in a determined manner.
VI. RESPONSIBILITY
- The driver of the vehicle is responsible for any damage caused on the Parking lot. The damage also covers damages and/or contamination of the Parking. The User is obliged to immediately inform the ADGAR employee or personnel about the event and to submit a written statement, no later than before leaving the Parking.
- ADGAR is not liable for damages, destruction, damage, and loss of the vehicle, its equipment and the property left in it by the user of the Parking.
- ADGAR is not responsible for any items left in the Parking lot, and if they are left, ADGAR may order their removal at the expense of their owner.
- ADGAR is liable for damages caused by the Personnel. The User is obliged to immediately inform the Personnel about the damage, no later than before leaving the Parking.
- All damages incurred on the premises of the Parking are eliminated under the obligatory third-party liability insurance of the perpetrator of the damage. ADGAR is not required to examine and investigate, who is the perpetrator of the damage.
- The person holding the Access Card or Ticket is recognized by ADGAR as authorized to enter the Parking, driving the vehicle in the Parking lot, and exit the Parking.
- In justified cases, ADGAR may demand the presentation of a document authorizing to drive a vehicle.
VII. USER’S OBLIGATIONS
- The fee for lost, destroyed or not returned Access Card after its expiration of the contract, will be calculated in accordance with the Price List.
- The User is obliged to notify ADGAR about the loss of the Access Card.
- The user is obliged to secure the vehicle against unauthorized persons. It is forbidden to activate audible signals in alarms, which are triggered in other circumstances than an attempt to break into the vehicle. Violation of the above prohibition, when it causes noise, results in the obligation to pay the fee specified in the Price List. Leaving the activated acoustic signal may also result in claims of persons and institutions, who have suffered damage because of this situation.
- It is recommended not to leave valuable items in the vehicle. ADGAR is not responsible for stolen items and for damage caused by theft.
- The liability of the Parking user for damages caused by the user shall be governed by applicable civil law.
VIII. CONDITIONS FOR THE USE OF THE PARKING
- Vehicles may only be parked at the designated parking spaces except for reserved place, which is properly graphically marked. If the User fails to comply with the above obligation, ADGAR is entitled to tow the vehicle at the user’s expense or charge an additional fee in accordance with the applicable Price List when more than one parking space is occupied, even if the occupation is only partial.
- Rights, referred to in paragraph 1 above, are granted to ADGAR in the situation when the user occupies more than one parking space unless, in the contract for the Parking use, the right to use more than one parking space will be explicitly granted.
- The User is obliged to respect road signs and other conditions of parking use, is obliged to compliance with Personnel instructions. ADGAR is authorized to remove the vehicle in the event of a sudden and justified threat.
- For failure to meet the conditions of the garage use, ADGAR may impose a reasonable financial penalty on the User.
- In special cases, the Personnel may order to tow a vehicle.
- The Personnel can put on the vehicle a sticker informing about breaking the rules.
IX. SAFETY REGULATIONS
- The provisions of the Traffic Code apply to the Parking.
- There is a ban on exceeding the speed of 10 km / h in the area of the Parking,
- In the Parking area, including parking spaces, internal roads, access roads, entry and exit ramps, it is prohibited to:
- Smoke and using open fire, Drink alcohol and use intoxicating drugs,
- storage of fuel, flammable substances, and empty fuel container
- Refueling vehicles
- Leaving the car with the engine running,
- Parking vehicles with leaky systems,
- Staying of unauthorized persons
- Movement of pedestrians on downhill ramps, with the exception of cyclists driving bicycles
- Running across the road
- Car service, including repairing, washing, vacuuming the car (excluding the car wash), exchange of fluids, refueling or oil filling, Tires swap, as well as polluting the Parking;
- The provision of paid services which were not agreed with ADGAR.
- In the underground Parking, it is obligatory to drive with switched on passing lights.
X. COMPLAINTS AND CONCLUSIONS
Complaints and requests related to the use of the Parking should be reported to Adgar BCV Sp. z o.o. (limited liability company) Sp. kom. (partnership company), Al. Jerozolimskie 181B, 02-222 Warsaw:
XI. EFFECTIVENESS OF THE REGULATIONS
- These Regulations are effective from August 1, 2016, and may be changed by ADGAR at any time, ADGAR will notify users about it immediately.
- The extract of the Regulations can be read at the entrance to the underground parking and at the security service.
XII. FINAL PROVISIONS
- The provisions of these Regulations take precedence over any other arrangements and agreements regarding the rules of using the Parking. The above statement does not apply to the principles of payment for the use of parking spaces established in separate agreements.
- For violation of any of the provisions of the above-mentioned statement, the Adgar / building owner/facility manager may impose a penalty in the amount of 1,000.00 – 5,000.00 Polish zloty for each incident.
