RULES AND REGULATIONS FOR USING THE GARAGE IN THE ADGAR PLAZA COMPLEX<\/strong><\/p>\n\n\n\n

<\/div>\n\n\n\n

These Rules and Regulations (hereinafter “Rules and Regulations”) govern the rules of using parking spaces for passenger cars located in the garages of the Adgar Plaza Complex, i.e. in:
(I) Adgar Plaza One building
(II) Adgar Plaza A and B building
(III) Free-standing garage building of the Adgar Plaza complex at ul. Post\u0119pu 15E in Warsaw, called MLG (Multi-level garage),
hereinafter referred to collectively as “Garage”, owned by Adgar.
Definitions:
Garage – underground car park with parking spaces under the Adgar Plaza One and Adgar Plaza A and B buildings as well as in a free-standing garage building.
Access Card – proximity card assigned to the User, providing access to the Garage and programmed on the basis of a separate agreement.

ADGAR \u2013 company Green and Efficiency Services Real Estate Solutions Sp. z o.o. Sp\u00f3\u0142ka Komandytowa Adgar or other companies from Adgar Group.
Ticket Office – cash desk located on levels -1 and -2 at the entrances to the elevator halls of Plaza A and B as well as at MLG.
I. GENERAL PROVISIONS<\/p>\n\n\n\n

    \n
  1. By entering the Garage with a vehicle, a driver and any other user of the vehicle (including the passenger) undertakes to comply with the provisions of these Rules and Regulations governing the principles of using the Garage. The use of the garage means the movement of a vehicle, parking or stopping a vehicle within the Garage.<\/li>\n\n\n\n
  2. Garage User is obliged to comply with all instructions of the security services, security personnel and manager authorised by ADGAR (hereinafter “the Staff”) to supervise the safety of the Garage.<\/li>\n\n\n\n
  3. Traffic in the Garage takes place in accordance with the indications of ADGAR employees or the Staff, as well as the installed road signs. The provisions of the Polish Act of 20 June 1997 Road Traffic Law (Dz.U. [Polish Journal of Laws No. 98, item 602 as amended) shall apply accordingly.<\/li>\n\n\n\n
  4. Garage User agrees that ADGAR may charge fees (Single entry ticket, hereinafter “the Ticket”) for the use of the Garage, in accordance with the price list constituting Appendix No. 1 to these Rules and Regulations (“the Price List”), unless they use the Garage on the basis of a separate Agreement signed by ADGAR or a subscription purchased in the parking ticket office.<\/li>\n\n\n\n
  5. Vehicle driver driving within the Garage should have legally required qualifications that meet the requirements set out by law.<\/li>\n<\/ol>\n\n\n\n
    <\/div>\n\n\n\n

    II. GARAGE ORGANISATION<\/strong><\/p>\n\n\n\n

      \n
    1. Access Card entitles a user to use a parking space in the Garage, depending on the type of subscription or Ticket purchased.<\/li>\n\n\n\n
    2. Garage is made available to Users 24 hours a day \/ 7 days a week. The time of using the Garage for Access Card holders is specified in the provisions of separate agreements or bookings.<\/li>\n\n\n\n
    3. Access Card Holder who exceeds the parking time to which the card type entitles them, is obliged to make an additional fee in the amount specified in the Price List.<\/li>\n\n\n\n
    4. The condition for renting a Garage space is signing an agreement with Adgar for renting a Garage space in the subscription system and\/or renting a space by purchasing a subscription at the parking ticket office or in the hourly system upon Ticket collection.<\/li>\n\n\n\n
    5. It is not possible to suspend or cancel a subscription purchased by a private person at the parking ticket office.<\/li>\n\n\n\n
    6. The offer of selling subscriptions at parking ticket offices is addressed only to private persons who are employees of Adgar Tenants’ offices.<\/li>\n<\/ol>\n\n\n\n

      III. TERMS AND CONDITIONS OF RENTING A GARAGE SPACE<\/strong><\/p>\n\n\n\n

        \n
      1. Access Card entitles a user to use a parking space in the Garage, depending on the type of subscription or Ticket purchased.<\/li>\n\n\n\n
      2. Garage is made available to Users 24 hours a day \/ 7 days a week. The time of using the Garage for Access Card holders is specified in the provisions of separate agreements or bookings.<\/li>\n\n\n\n
      3. Access Card Holder who exceeds the parking time to which the card type entitles them, is obliged to make an additional fee in the amount specified in the Price List.<\/li>\n\n\n\n
      4. The condition for renting a Garage space is signing an agreement with Adgar for renting a Garage space in the subscription system and\/or renting a space by purchasing a subscription at the parking ticket office or in the hourly system upon Ticket collection.<\/li>\n\n\n\n

        IV. FEES AND PARKING TIME<\/strong><\/p>\n\n\n\n

          \n
        1. Collected Ticket entitles to park a vehicle in a non-dedicated space, not marked with a company\u2019s name.<\/li>\n\n\n\n
        2. Parking fee is charged for every commenced hour from the moment of entering the garage in accordance with the Price List, and it is paid at the marked Ticket Office or on the terms specified in the rental agreement.<\/li>\n\n\n\n
        3. Vehicle driver may leave the Garage building only after paying the parking fee at the Ticket Office.<\/li>\n\n\n\n
        4. The Ticket or Access Card entitles to park only in designated places.<\/li>\n\n\n\n
        5. After paying the Ticket, vehicle driver has 20 minutes to leave the Garage free of charge. If this time is exceeded, the fee for the stay in the parking space is charged in accordance with the price list.<\/li>\n\n\n\n
        6. In the event of difficulties with departure (problems with the card, payment), the User should immediately use the designated technical parking space, contact security office using intercom (handset button in the parking column or the Ticket Office), and then go to the security office at the reception desk of the Plaza A building – ul. Post\u0119pu 17A (open 24\/7)<\/li>\n\n\n\n
        7. In the event of a failure of the Ticket Office, payment takes place at the next, nearest Ticket Office. In the event of failure of all Ticket Offices, payment is made in cash at the reception desk of Plaza A building (ul. Post\u0119pu 17A).<\/li>\n\n\n\n
        8. The fee for a lost ticket is PLN 50 gross and is made at the reception desk of the Plaza A building.<\/li>\n\n\n\n
        9. Leaving the garage without a paid Ticket (e.g. behind another vehicle) will be treated as an offence or a fraud and reported to the police station.<\/li>\n\n\n\n
        10. In emergency cases and the need to unblock the exit, it is necessary to go to the Plaza A reception desk in order to write down a report of manual opening of the barrier.<\/li>\n\n\n\n
        11. For Access Card Users, leaving the Garage outside the card validity hours will be possible only after reporting the fact to the Staff and making a payment for exceeding the card’s time limit in accordance with the Price List.<\/li>\n\n\n\n
        12. ADGAR considers a person with an Access Card or a Ticket to be authorised to drive and leave the Garage with a given vehicle.<\/li>\n\n\n\n
        13. User reports the need to receive an invoice at the reception desk of the Plaza A building, leaving invoice details. Invoice will be issued within 7 days and delivered to the User in the agreed manner.<\/li>\n<\/ol>\n\n\n\n
          <\/div>\n\n\n\n

          VI. OLIABILITY<\/strong><\/p>\n\n\n\n

            \n
          1. Vehicle driver is liable for any damage caused in the Garage. The liability also covers damages consisting in endamaging and\/or contaminating the Garage. User is obliged to immediately inform ADGAR employee or staff about a given event, and submit a written declaration, no later than before leaving the Garage.<\/li>\n\n\n\n
          2. ADGAR is not liable for any damage, destruction, endamaging and loss of a vehicle, its equipment and property left in it for reasons attributable to the Garage user or force majeure.<\/li>\n\n\n\n
          3. ADGAR is not liable for items left in the Garage, and if they are left there, it may order their removal at the expense of their owner.<\/li>\n\n\n\n
          4. ADGAR is liable for all culpable damages caused by the Staff. User is obliged to immediately inform the Staff about the occurrence of damage, but not later than before leaving the Garage.<\/li>\n\n\n\n
          5. Any damage caused in the Garage is liquidated under the compulsory third party liability insurance OC of the perpetrator of the damage.<\/li>\n\n\n\n
          6. A person with an Access Card or a Ticket is recognised by ADGAR as authorised to enter the Garage, drive a vehicle in the Garage, and leave the Garage.<\/li>\n\n\n\n
          7. In justified cases, ADGAR may require the presentation of a document authorising to drive a vehicle.<\/li>\n<\/ol>\n\n\n\n
            <\/div>\n\n\n\n

            VII. USER RESPONSIBILITIES<\/strong><\/p>\n\n\n\n

              \n
            1. The fee for an Access Card that is lost, damaged or not returned after the termination of the agreement, will be charged in accordance with the Price List. User is obliged to notify ADGAR in writing about the loss of the Access Card. New Access Card will be issued after the User pays for the new card.
              2.<\/li>\n\n\n\n
            2. It is recommended not to leave valuables in the vehicle. ADGAR is not liable for stolen items as well as damage caused by theft.<\/li>\n\n\n\n
            3. The liability of the Garage User towards other users for damages caused in connection with the use of the Garage is regulated by the relevant provisions of civil law.<\/li>\n\n\n\n
            4. ADGAR is not liable for any damage caused within the garages. Monitoring is limited to controlling the main traffic routes.<\/li>\n<\/ol>\n\n\n\n
              <\/div>\n\n\n\n

              VIII. GARAGE USE TERMS AND CONDITIONS<\/strong><\/p>\n\n\n\n

                \n
              1. Vehicles may only be parked within parking spaces and on non-dedicated spaces.<\/li>\n\n\n\n
              2. It is forbidden to park on dedicated spaces, marked with plates with the name and\/or logo of the Tenant. If the User fails to comply with the above obligation, ADGAR is entitled to tow the vehicle away at the User’s expense or to charge an additional fee in accordance with the applicable Price List.<\/li>\n\n\n\n
              3. The rights referred to in section 1 above are granted to ADGAR if the user uses more than one parking space, unless the agreement for the use of the Garage explicitly grants the right to use more than one parking space.<\/li>\n\n\n\n
              4. User is obliged to respect road signs and other conditions of use of the Garage, as well as to follow the instructions of the Staff. ADGAR is authorised to remove a vehicle in the event of a sudden and justified threat.<\/li>\n\n\n\n
              5. For failure to comply with the conditions of use of the Garage, ADGAR may impose a reasonable financial penalty on the User, specified in the Price List, which constitutes Appendix No. 1 to these Rules and Regulations.<\/li>\n\n\n\n
              6. In special cases, the Staff may order the vehicle to be towed away.<\/li>\n\n\n\n
              7. The Staff may put a card on a vehicle informing about non-compliance with the provisions of the Rules and Regulations.<\/li>\n<\/ol>\n\n\n\n
                <\/div>\n\n\n\n

                IX. SAFETY REGULATIONS<\/strong><\/p>\n\n\n\n

                  \n
                1. The provisions of the Polish Traffic Code shall apply within the Garage.<\/li>\n\n\n\n
                2. The maximum speed allowed in the Garage is 10 km\/h.<\/li>\n\n\n\n
                3. In the Garage, including parking spaces, internal roads as well as entry and exit ramps, it is prohibited to:
                  a) Smoke and use open fire, drink alcohol and use intoxicants,
                  b) Store fuels, flammable substances and empty fuel containers,
                  c) Refuel vehicles,
                  d) Leave a car with the engine running,
                  e) Park vehicles with leaking systems,
                  f) For unauthorised persons to stay there,
                  g) Remain there in time exceeding the time necessary to park or take the car out of the Garage,
                  h) Move around by pedestrians on downhill ramps (entry, exit from the garage),
                  i) Ride with two-wheelers on downhill ramps,
                  j) Service cars, including: repair, wash, vacuum a car (excluding a car wash), change fluids, refill fuel or oil, change tires, as well as pollute the Garage;
                  k) Provide commercial services not agreed with ADGAR.
                  l) Charge electric cars and scooters in places not intended for this purpose<\/li>\n\n\n\n
                4. In the Garage, driving with the dipped headlights is obligatory.<\/li>\n<\/ol>\n\n\n\n
                  <\/div>\n\n\n\n

                  X. COMPLAINTS AND REQUESTS<\/strong>

                  XI. VALIDITY OF THE RULES AND REGULATIONS<\/strong><\/p>\n\n\n\n

                    \n
                  1. These Rules and Regulations enter into force on 1 March 2021 and apply to the Garage users from 6.00am on that day.<\/li>\n\n\n\n
                  2. You can read the extract of the Rules and Regulations at the entrance to the Garage and at the reception desks of the Adgar Plaza complex.<\/li>\n<\/ol>\n\n\n\n

                      <\/div>\n\n\n\n

                      XII. FINAL PROVISIONS<\/strong><\/p>\n\n\n\n

                        \n
                      1. The provisions of these Rules and Regulations take precedence over any other arrangements, including agreements regarding the rules of using the Garage. The above does not apply to the rules of payment for the use of parking spaces.<\/li>\n\n\n\n
                      2. Within the meaning of these Rules and Regulations, the User is each person driving a vehicle located in the Garage.<\/li>\n<\/ol>\n\n\n\n

                        Appendix No. 1 PRICE LIST in accordance with the valid price list displayed in the garage.
                        Appendix No. 2 Fire Safety Instructions.<\/p>\n\n\n\n
